WEBSITE TERMS OF USE & ACCEPTABLE USE POLICY

1. Scope

These terms govern your use of this website, whether or not you buy anything. Purchases are governed separately by our Terms and Conditions of Sale, and business accounts additionally by our Business Account Terms.

By accessing the site you agree to these terms. If you do not agree with them, please do not use the site. In terms of section 11(3) of the Electronic Communications and Transactions Act 25 of 2002, these terms are incorporated by reference and are accessible at this address at all times.

2. Your Account

• You must be at least 18 years old to open an account, or act with the consent of a parent or legal guardian.
• The information you give us must be accurate and kept up to date. This is not merely administrative — an out-of-date email address or telephone number can mean we cannot reach you with a safety or recall notice.
• You are responsible for keeping your sign-in credentials confidential and for everything done under your account. Tell us immediately at support@g1healthcare.co.za if you believe someone else has accessed it.
• One account per person or organisation. Do not share credentials between users; on a business account, ask us to add each user with the role they need.
• We may suspend or close an account that is used in breach of these terms, that appears to be fraudulent, or that has been dormant for an extended period.

3. Acceptable Use

You may use this site to browse products, buy them, manage your account and contact us. You may not:

• use the site for any unlawful purpose, or in breach of the Medicines and Related Substances Act 101 of 1965 or any other applicable law;
• misrepresent your identity, your organisation, or your entitlement to buy a restricted product;
• submit a forged, altered, borrowed or expired licence or prescription;
• buy in order to resell outside an authorised distribution arrangement, or to export without our written consent;
• attempt to gain unauthorised access to any account, server, database or system, or probe, scan or test the site's security;
• scrape, harvest, crawl or systematically extract content, pricing or user data, or use an automated tool against the site other than a well-behaved search engine crawler observing our robots directives;
• introduce malware, or interfere with the site's availability or the integrity of its data;
• circumvent a technical restriction, including the view-only presentation of our regulatory certificates;
• place fraudulent or speculative orders, abuse coupon codes, or manipulate stock or pricing; or
• use the site to harass any person or to send unsolicited commercial communications.

Conduct in this clause may constitute an offence under Chapter 2 of the Cybercrimes Act 19 of 2020, and we will report it where appropriate.

4. Product Reviews and Anything Else You Submit

4.1 Who may review. Reviews may be submitted by signed-in account holders. Where our records show you bought the product, the review is marked as a verified purchase. You may post one review per product, which you may edit at any time.

4.2 What is published. Your rating, title and comment, your display name — or, if you have not set one, the part of your email address before the @ sign — and the date. Your full email address is never published.

4.3 Content standards. Your review must be your own genuine experience. Do not post:

• medical advice, dosage or treatment recommendations for other readers;
• claims that a product treats, cures or prevents a disease — such claims are regulated and we cannot host them;
• another person's personal or health information, including a family member's, without their consent;
• unlawful, defamatory, discriminatory, obscene, threatening or harassing content;
• content that infringes anyone's copyright, trade mark or other rights;
• spam, advertising, referral or affiliate links, or competitor promotion; or
• reviews written in exchange for payment, a discount, or any other inducement, whether by you or on your behalf.

4.4 Safety reports do not belong in a review. If a device failed, leaked, or caused a skin reaction, a review is the wrong channel and we may not see it in time. Report it under our Product Safety, Adverse Event & Recall Policy. We monitor reviews for safety signals and will open a vigilance record and contact you if one appears, but this is a backstop, not a substitute for reporting.

4.5 Moderation. We may remove or decline to publish a review that breaches these standards, and will tell you why. We do not remove a review merely because it is negative, and we do not edit the substance of a review. We publish all reviews that meet these standards, favourable or not.

4.6 Licence to us. By submitting a review you grant us a non-exclusive, royalty-free, worldwide licence to publish, reproduce and display it in connection with the product and our business, and to keep it published if you later close your account, unless you ask us to remove it. You confirm the content is yours to submit. You may withdraw a review at any time by contacting us.

4.7 Reporting a review. If a review breaches these standards or discloses your personal information, email support@g1healthcare.co.za and we will act promptly.

5. Content on This Site Is Not Medical Advice

Product descriptions, health resources, FAQs and reviews on this site are general information. They are not medical advice, and they are not a substitute for consulting your doctor, surgeon, stoma therapist or stoma care nurse. Reviews in particular are the personal experience of the person who wrote them and are not endorsed or verified by us as clinically accurate. See our Website & Medical Device Disclaimer.

6. Availability, Accuracy and Changes

We aim to keep the site available and its content accurate, but we do not guarantee uninterrupted or error-free operation. We may change, suspend or withdraw any part of the site, any product listing, or any feature, at any time and without notice. Prices, stock levels and specifications shown are subject to the confirmation described in our Terms and Conditions of Sale.

Planned maintenance may make the site briefly unavailable. Orders left unpaid for more than 24 hours are cancelled automatically, and you are free to place them again.

7. Intellectual Property

All content on this site — the G1 Healthcare name and logo, text, product descriptions, health resources, photographs, graphics, layout, design and software — is owned by or licensed to G 1 Healthcare (Pty) Ltd and is protected by the Copyright Act 98 of 1978 and the Trade Marks Act 194 of 1993.

You may view the site, and print or download extracts for your own non-commercial reference. You may not otherwise copy, republish, adapt, distribute, sell or use our content or branding without our prior written consent. Manufacturer names and marks appearing on product pages belong to their respective owners and are used for identification only.

Regulatory certificates are presented view-only and watermarked to prevent misuse. Reproducing, altering or presenting them as your own is prohibited and may constitute an offence.

If you believe content on this site infringes your rights, notify us at support@g1healthcare.co.za with enough detail to identify the material and your right in it. Where the notice meets the requirements of section 77 of the Electronic Communications and Transactions Act, we will act on it in accordance with Chapter XI of that Act.

8. Links to and from This Site

We link to third-party sites — regulators, payment providers, manufacturers — for your convenience. We do not control them, we are not responsible for their content or practices, and a link is not an endorsement. Read their own terms and privacy policies before using them.

You may link to our home page in a way that is fair and does not damage our reputation. You may not frame our pages, present our content as your own, or imply an association or endorsement that does not exist.

9. Communications From Us

Transactional messages — order confirmations, dispatch notices, RFQ acknowledgements, restock alerts you requested, replies to your enquiries, and safety and recall notices — are sent because you transacted with us or asked us to. Safety and recall notices for a product you have received cannot be opted out of.

Marketing is governed by section 69 of POPIA, section 45 of the Electronic Communications and Transactions Act, and section 11 of the Consumer Protection Act. Every marketing message carries an unsubscribe link, and you may object at any time. See clause 12 of our Privacy Policy.

10. Privacy and Cookies

Your use of this site is subject to our Privacy Policy and Cookie Policy, which explain what we collect, who we share it with, where it is processed and what rights you have under POPIA.

11. Liability for Use of the Site

To the maximum extent permitted by law, we are not liable for loss or damage arising from your use of, or inability to use, this site, including loss arising from reliance on its general content, from a virus or other harmful component, or from a third-party site you reach through a link. Nothing in this clause limits our liability for death or personal injury caused by our negligence, for fraud, for defective products, or any other liability that cannot lawfully be excluded — including under the Consumer Protection Act 68 of 2008 where it applies to you.

12. Breach, Changes and Governing Law

Where these terms are breached we may issue a warning, remove content, suspend or close the account, block access, disclose information to law enforcement, or take legal action.

We may amend these terms at any time; the version published here governs your use of the site from the date it is posted. If any provision is found unenforceable, the rest continues to apply.

These terms are governed by the law of the Republic of South Africa and are subject to the jurisdiction of the South African courts. Complaints may also be referred as set out in clause 19 of our Terms and Conditions of Sale.
